Parking Tickets - Have You Been Fined Illegally?
There has been a drastic increase in a bout of a few years in the allocation and collection of parking fines. The purpose of the fine was to ensure that motorists would adhere to the limits and restrictions for the safety of one and all. But, today it is a mere excuse for a beneficial endowment into the Government’s stake. The intention has become different and we all are feeling it heavily on our pockets.
A record 3,402,860 parking tickets were issued in 2005, 19 percent up on 2004. Yet only 794,851 parking tickets were issued in 2000-2001. Around the same time a lot of Councils have taken over parking enforcement from the police leaving many people to believe that Councils are cashing in with the over use of the parking fine rather than trying to keep the roads clear and safe. These parking fines are not ring fenced by Government so the fines do not go back into local transport.
The top 5 towns with the biggest number of parking tickets issued were Birmingham 176,382, Brighton & Hove 160,018, Manchester 136,005, Liverpool 92,642 and Nottingham 75,350. The National Parking Adjudication Service - the national body which deals with appeals lodged by motorists issued parking tickets - says councils must not play “fast and loose” with the legal restrictions on tickets.
This institution known as the NPAS handles all the left-over appeals from when the local authorities pass them over.
When the councils are approached by ticket appeal companies, there is a 100% chance it will just pass without finding its way into the NPAS at all. 2006 was a lucky year, 57% appeals won at the NPAS.
‘Decriminalised Parking’ is a term penned by the ‘The Road Traffic Act 91′. This act allows the local councils to increase the fine rates on any and every area as a stable increase year after year. But, the council’s have been very callous. There are many new and astonishing stories circulating around us today, such as the one in which a double line had been painted under a car so it could be fined a good amount.
Sometimes, while just in the process of changing the order, motorists are ticketed. This is unjust. Even the NPAS has denounced it.
Moreover, it may be the case that the the motorist is stuck at the pay and display machines, behind an indecisive driver, in which case the fine should be pardoned.
As the NPAS says: “Some councils hold the unbending belief that the motorist’s duty is to have the right change in his possession before entering the car park - whatever the circumstances.” Others appear to regard the act of going for change as a contravention in its own right. “This is not the case.” So it is usual to get a parking fine whatever the individual circumstances are.
In these kinds of cases you should always appeal. Do not presume the Council are always right. Many types of Council blindly apply parking regulations and unless challenged through appeals will carry on penalizing the hapless motorist unfairly.
